How can Chester Hill approved unauthorised construction in Solan/Shimla?

The Chester Hills Solan fraud case refers to numerous complaints filed by residents against the developer, M/s N G Estates, with the Real Estate Regulatory Authority (RERA) of Himachal Pradesh, alleging fraud and mismanagement, primarily due to the failure to complete essential infrastructure like boundary walls, and builder is not providing the completion certificate, HP government and local administration is not taking any action after multiple complaints. Chester hill management is now shut all the water and electricity connections of those who raised complaints against Chester Hill. And not provides proper security in the "gated community," and address other issues after receiving significant payments.

  • Failed to build boundary walls:
    Despite being advertised and reported as complete, the project lacks boundary walls to secure the perimeter and prevent external issues. 
  • Inadequate security:
    The project, promoted as a "gated community," lacks proper security measures and infrastructure, compromising the safety and exclusivity promised to buyers. 
  • Mismanagement of funds and utilities:
    Residents have complained about the developer's failure to resolve issues and their alleged lack of collaboration in addressing the problems, despite having paid for these services. 
  • Unauthorized construction:
    A separate building by another individual, Mr. Rajiv Shandil, was constructed without resident consent or the necessary documentation shared with the planning authorities, which residents are seeking to have demolished. 
  • Unapproved access/paths:
    There are concerns about the builder's right to enter into new agreements for sharing paths and common services without the consent of the Residents' Welfare Association (RWA). 
Legal Action and Outcomes
  • Residents have filed a formal complaint with the HPRERA and are requesting the authority to intervene and provide relief for the grievances. 
  • The residents also seek to prevent the builder from entering new agreements and to halt any planning permissions on shared paths without the RWA's consent. 
  • An application has been made to the Civil Court to consider the matter under RERA laws.
